Request for Reconsideration of Penalty (RFR)

A plan’s filing team members (who have the plan in their accounts) may access the Penalty RFR Page via the “Submit Request” link on the Plan Details Page to request reconsideration of a penalty assessment. This is generally a more efficient way to submit such requests to the PBGC since you will now receive an immediate confirmation and tracking number upon receipt.
 
Here are the primary details:
  • The user must select at least one PYC from the list of available plan years and enter the corresponding penalty amount.
  • Selections may also be made for additional PYCs along with the penalty amount for each.
  • The reason for the request must be entered in the Comments section (up to 2000 characters) and/or included in a file that is uploaded (a single PDF file which cannot exceed 15MB).
  • The Next button is selected to go to a page that summarizes the information entered and performs basic validations (e.g., a warning shows if a required field is left blank).
  • The following buttons may be selected: a Back button to go back to the previous page, a Cancel button to completely cancel the request, and a Submit button when the user wants to submit the request to PBGC.
  • When the request has been successfully submitted, the submitter will receive a Confirmation message that includes the Service Request Number. In addition, a confirmation email will be sent to each e-filing team member who has the plan in their account.
